These Terms & Conditions (“Terms”) govern your access to and use of WattSmart (the “App”) and WattSmart.app (the “Website”), operated by ItSmart (“we”, “us”, “our”). By using the App or Website, you agree to these Terms.

If you do not agree, do not use the App or Website.

1) What WattSmart does

WattSmart provides tools to view and compare electricity price information (including “today” and “tomorrow” prices), visualizations, alerts, and related features.

Informational use only. The App may display day-ahead electricity prices and related calculations for convenience. Displayed values may differ from your final billed price due to supplier margins, network fees, taxes, metering rules, tariff structures, and other factors.

2) Data sources and availability

WattSmart may use third-party data sources (for example, the ENTSO-E Transparency Platform and/or national market operators, and other public sources). We do not control these sources and cannot guarantee data will always be available, complete, timely, or error-free.

We may correct, update, or remove displayed data and change how information is presented.

3) “Real-time” display

Some features highlight the current hour or 15-minute slot based on published schedules and available day-ahead data. “Real-time” in WattSmart refers to real-time highlighting and presentation, not a guarantee of live trading data.

4) Taxes & Surcharges settings

If enabled, the App can adjust displayed prices using a fixed surcharge and/or a percentage-based tax (e.g., VAT). These settings are user-configured estimates intended for convenience.

Unless the App states otherwise, adjustments are applied in this order:

  1. The fixed surcharge is added.
  2. Then the percentage tax is applied.

You are responsible for verifying your tariff details and ensuring that any configured values are appropriate.

5) Eligibility

You must be legally able to enter into these Terms and comply with applicable laws.

6) Acceptable use

You agree not to:

  • misuse the App/Website, reverse engineer, or attempt unauthorized access;
  • disrupt or interfere with services, data feeds, or security;
  • scrape, copy, or redistribute content or data in ways that violate laws or third-party terms.

We may suspend or restrict access if we reasonably believe you violate these Terms.

7) Ads and third-party services

The App may display ads and may include third-party services (e.g., analytics, crash reporting, ad networks). These providers may process certain device and usage data under their own terms and privacy policies.

8) One-time purchase (Premium Unlock)

WattSmart may offer a one-time in-app purchase (“Premium Unlock”). If you buy Premium Unlock, it enables premium features on supported devices.

No subscription. Premium Unlock is not a recurring payment.

Purchases are processed by your platform provider (Apple App Store / Google Play). Availability, pricing, and purchase restoration are controlled by the platform’s rules and your account settings.

Refunds are handled according to the platform’s refund policies, unless local law requires otherwise.

9) Intellectual property

We (or our licensors) own the App, Website, branding, and all related intellectual property, except third-party components and third-party data, which remain the property of their respective owners.

You receive a limited, non-exclusive, non-transferable, revocable license to use the App/Website for personal, non-commercial purposes, subject to these Terms.

10) Feedback

If you send feedback, suggestions, or ideas, you grant us the right to use them without restriction or compensation, unless prohibited by law.

11) Disclaimers

To the fullest extent permitted by law, the App/Website is provided “as is” and “as available.” We disclaim all warranties, including fitness for a particular purpose, accuracy, and non-infringement.

We do not guarantee uninterrupted operation, data availability, or that the App/Website will be error-free.

12) Limitation of liability

To the fullest extent permitted by law, we are not liable for:

  • indirect, incidental, special, consequential, or punitive damages;
  • loss of profits, savings, data, business, or goodwill;
  • decisions made based on displayed prices, calculations, or alerts;
  • issues caused by third-party services, data sources, networks, or app store platforms.

Our total liability for any claim related to the App/Website is limited to the amount you paid us (if any) during the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations; in that case, the limitation applies to the maximum extent allowed.

13) Termination

You may stop using the App at any time. We may suspend or terminate access if required by law, for security reasons, or for violations of these Terms.

Sections that should survive termination (IP, disclaimers, limitation of liability, governing law) remain in effect.

14) Changes to the App or Terms

We may modify the App/Website and these Terms from time to time. We will update the “Last updated” date. Continued use after changes means you accept the updated Terms.

15) Governing law and disputes

These Terms are governed by the laws, without regard to conflict of law rules. Courts will have jurisdiction, unless mandatory consumer protection laws provide otherwise.
